Frequently asked questions

What is Family Dispute Resolution?

FDR is a form of mediation focused on the best interests of the children in the family and is usually used to reach agreement on parenting arrangements and financial and property matters for couples who are divorcing.

A parenting or property agreement/plan is not a legally enforceable agreement however it can become the basis for one via the Family Court. Your lawyer can guide you through this simple process.

  • Mediation provides parties with the opportunity to resolve their dispute in an open, safe & effective way. It’s a collaborative effort focussed on the children. This is markedly different to adversarial legal proceedings where decisions are made for you in court.
  • Mediation is extremely cost effective compared to having your day in court.
  • With mediation you can deal with your dispute quickly and effectively and get on with life.  The alternative is lawyers and court and this may take months or years to reach a conclusion.

In most cases under Family Law, it is compulsory for parties to make a genuine attempt to resolve disputes through Family Mediation before commencing court proceedings. There are some exceptions which we can discuss with you.

FDR is Family Dispute Resolution (mediation) and it is carried out by an FDRP (Family Dispute Resolution Practitioner (mediator.))

FDRP’s are specialist mediators who have completed post-graduate training in this area and are registered with the Australian Attorney-General’s Department.

Terms like FDR, mediation, family mediation, FDRP and mediator are often used interchangeably.

A parenting plan is a written agreement that sets out parenting arrangements for children. The plan is worked out and agreed jointly, you and your former partner do not need to go to Court.

This an agreement reached that outlines a property and financial settlement between the parties in dispute.

The process involves:

  • parties agreeing on a list of assets and debts and their value
  • discussions about contributions and future needs
  • presentation of options
  • discussion and negotiation
  • finalising agreements

No. If the circumstances around the separation are such that you’d rather not see or communicate directly with the other party then shuttle mediation is an option.

This mediation method ensures that neither party is able to see or communicate with the other and the mediator acts as the ‘shuttle’ between the two.
